The Boss makes a beer run during concert

They don't call him The Boss for nothing.

During a stop on the "Wrecking Ball" tour in Philadelphia on Tuesday, Bruce Springsteen, still spry at 62, waded into the crowd?while singing "Raise Your Hand." Part way through the song, the singer announced "I need to sit down" and took a seat, at which point an adoring fan handed him a cup of beer -- that Springsteen downed in the blink of an eye, and then jumped up and continued the song.

At the same time, 35 percent of people surveyed by home-service contracting matchmaker ServiceMagic.com, said they put off a home improvement project last year; only half of those people said they plan to tackle that postponed project this year.

Craig Smith, ServiceMagic.com?s CEO, told the Wall Street Journal that requests for carpet cleaning services, furniture repairs and preventive maintenance on heating and air conditioning systems are on the rise, while requests for architects, engineers, designers and remodelers have dramatically declined.

Prostate cancer vaccine Provenge has long incited passions unlike any other cancer therapy.

Doctors who raised doubts about it received death threats. Health regulators and lawmakers faced loud protests at their offices. A physician at the American Cancer Society was so intimidated by Provenge partisans that he yanked a skeptical discussion of it from his blog.

The vitriol dissipated in April 2010, when the U.S. Food and Drug Administration approved Provenge for advanced prostate cancer, satisfying investors in manufacturer Dendreon and patients who for years had demanded it be put on the market.

But the bell on Round Two sounded when Marie Huber, a trained scientist and former hedge-fund analyst, made it her mission in the last year to analyze what she believes are deadly flaws in the studies that led to the approval of Provenge by the FDA.

She argues that the main reason Provenge seemed to extend survival - a crucial factor in the FDA?s decision - was that older men in the study who did not receive Provenge died months sooner than similar patients in other studies.

She raises the possibility the ?placebo? they received was actually harmful and made Provenge, known scientifically as sipuleucel-T, look better by comparison.

As Huber gains traction, most notably with a February paper in the prestigious Journal of the National Cancer Institute, she, too, is receiving threats. One post on an investors? message board last month suggested that ?somebody smack her with a rubber hose.? An email said ?don?t think you will be unscathed in this battle you waged on Provenge.?

Provenge is Dendreon?s only product and the company?s stature with investors has waned with disappointing sales. In 2011, product revenues totaled $213.5 million, far from the $400 million Dendreon initially projected.

The company insists Huber?s analysis is flawed and that Provenge has helped thousands of men with prostate cancer.

?I?m looking forward to getting this to patients around the world,? said President and Chief Executive John Johnson.

FIRST CANCER VACCINE

Since it won FDA approval two years ago, Provenge has been Exhibit A for the idea that a patient?s immune system can control or cure cancer. The first therapeutic cancer vaccine to reach the market, Provenge tries to engineer white blood cells, part of the immune system, to vanquish prostate cancer, which killed an estimated 33,720 men in the United States last year.

Its path to approval has all the features of a heavyweight healthcare fight - desperate patients demanding access to a promising therapy, a very expensive drug that extends life only a few months and efficacy data open to interpretation.

The FDA declined to approve the drug in 2007, when a clinical trial failed to show it slowed tumor growth. That incited protests, lawsuits and death threats against physicians on the FDA advisory panel who did not recommend approval, breaking with the 13-4 majority in favor.

?Provenge came along when we didn?t have much to offer for prostate cancer,? said Dr. Len Lichtenfeld of the ACS. ?The advocacy community was bursting at the seams for something that worked. When you have that situation, it inflames passions and that can overtake the science.?

In the pivotal trial called IMPACT, published in July 2010, but shared with the FDA months earlier, Provenge extended median survival by 4.1 months to 25.8 months from 21.7 months. That was sufficient for FDA approval. The vaccine costs $93,000 and patients also incur physician and other charges. Medicare agreed to cover Provenge last year, as have private insurers, but doctors initially balked at a long wait for reimbursement.

Huber had long been ?utterly intrigued? by Provenge and its ?huge promise of harnessing the immune system to battle cancer,? she said in an interview.

In documents JNCI requires authors to sign, she declared no financial conflicts of interest. Neither she nor her former firm nor anyone else she is connected to stands to benefit financially from her analysis, she said.

Instead, she says she is motivated to help ?vulnerable and desperate patients? - so much so that she gave up her job, salary and health insurance. Arguing that Provenge is harming these men, she called ?the whole thing utterly horrific. The company got away with hiding data and doctors making $7,000 per prescription won?t even engage in discussion? about whether it helps their patients.

After receiving degrees in biochemistry and bioscience enterprise from Cambridge University, Huber began working as an analyst for a hedge fund in 2007. A Thomson Reuters analysis of securities filings confirmed her former firm has not held any positions in Dendreon.

LACK OF EVIDENCE

Each dose of Provenge is custom-made. A nurse or technician withdraws white blood cells from a man?s arm in a three-to-four hour procedure called leukapheresis.

The cells are shipped to a Dendreon manufacturing facility, where for two days they are incubated with a ?fusion protein:? One protein that stimulates the cells? growth and maturation and another called PAP, or prostatic acid phosphatase. PAP is an antigen that studs prostate cancer cells like antennae, pieces of it sticking out of the cells? surfaces.

Police: Two TSA agents held in drunken rampage

A pair of South Florida TSA agents face criminal charges after police say they went on a drunken rampage inside a Miami Beach hotel room, throwing furniture out a window and wildly firing a gun, NBCMiami.com reported.

Jeffrey Piccolella, 27, and Nicholas Puccio, 25, are both charged with criminal mischief and using a firearm under the influence of alcohol or drugs in the Tuesday night incident at the Shelby Hotel, according to a Miami Beach police report obtained by NBCMiami.com.


Officers called to the hotel around 11 p.m. after reports of a gun being discharged from a second-floor room took the two agents into custody without incident, the report said. Each had a strong breath odor of alcohol and bloodshot and watery eyes, the report said.

On the ground outside the hotel room, officers found a radio, speakers, two lamps, a phone, an ice chest, a shattered vase and a bullet casing, the report said.

Piccolella admitted that the pair had returned to the room after having several drinks and started throwing the items out the window, the report said.

Piccolella said he had fired the gun out the window once, handed it to Puccio, who also fired once, and then got the gun back and fired three more times, according to the report.

One bullet struck a $1,500 hurricane-proof window at the Barneys New York at 832 Collins Ave., the report said. The hotel items were worth $400, it said.

Puccio denied any involvement in the incident, the report said.

The Transportation Safety Administration said both are part-time employees at Palm Beach International Airport and were not traveling on official business.

"TSA holds its employees to the highest professional and ethical standards. We will review the facts and take appropriate action as necessary," the TSA said in a statement obtained by NBCMiami.com.

Both Piccolella, of West Palm Beach, and Puccio, of Delray Beach, were being held on $5,500 bond, NBC Miami said.

Elvuyra Perez Gallego, visiting Miami from Spain for the first time, told NBCMiami.com?she was scared when she came back to the hotel from a late night out and saw police blocking the street surrounding her hotel.

She said she has sat on the hotel patio many times this week to use her computer and socialize, and she doesn't like thinking about what could happen with a stray bullet.

FreedomPop plans to give away mobile internet, still make money somehow

"Freemium" mobile broadband outfit FreedomPop has pulled back the curtain on how it plans to make money while giving away 4G internet. In an interview with GigaOm, Marketing VP Tony Miller revealed that once it has got enough consumers hooked on the gratis data, his company will start selling premium features, potentially including a VoIP solution for the network, now supplied by Clearwire after the collapse of LightSquared. The company will also charge a penny for every megabyte used over the free monthly allowance (currently pegged at 1GB) and build a social network where more data can be earned and traded between friends. Alongside the WiMAX shell for the iPhone, we can also expect to see an iPod Touch edition, USB dongle and mobile hotspot arrive before the network's launch. The company doesn't have too long to iron out the kinks in the business plan however, as it'll go live in the third quarter of 2012.

Why an Italian lawmaker's phone call trumps Obama's speech

Italian Prime Minister Mario Monti's decision to take a call from an Italian lawmaker during President Barack Obama's speech highlights the tentativeness of his claim to authority.

According to leaks from Mr. Monti's staff, he had to take an ?urgent call? from Fabrizio Cicchitto, a senior lawmaker from former leader Silvio Berlusconi's Freedom Party, just as the United States president began his speech during yesterday's nuclear energy summit in Seoul. The prime minister's?staff refused to disclose the topic of such an urgent conversation.?

While the world was well-acquainted with Mr. Berlusconi's gaffes (such has his description of Obama as a ?young man with a nice tan?), the new prime minister's faux-pas was quite unexpected.?Of the 52 world leaders at the summit, he was the only one who skipped Obama's speech.?He was also the only leader openly mentioned in the same speech ? a move widely interpreted as a demonstration of Mr. Obama's esteem.

Monti ? a former university headmaster and European commissioner with an understated, professorial manner ? seemed to fit in better than Berlusconi at international summits, making Monti well-suited to the task of restoring Italy's image abroad. It's one of the reasons Monti was chosen by the Italian Parliament to lead a transitional government when Berlusconi resigned last year.?

But while Monti has a better international reputation than his predecessor, at home he is much less respected.

As a crisis-time leader who was appointed, not elected, some view Monti as a lame duck hostage to a Parliament still controlled by Berlusconi's People of Freedom party, and to them the fact that he put a Freedom party lawmaker over Obama confirms this view.

The anecdote became a hit on the Italian blogosphere and reached Twitter's top trends, with many cracking jokes on the newly-acquired status of Mr. Cicchitto, a medium-profile politician.

Among the jokes: ?Pope Benedict had to postpone his meeting with Fidel Castro. He had to take a call from Cicchitto.?

5.Ultimately, the loss of the business as a result of one of, or a combination of these factors and many others.

If the business is the main source of income for the owner, the personal financial situation of the business owner is at risk and so is his ability to support his family and take care of his obligations.

"Everything from aspirin to multivitamins - you name it - it's all jammed up," said Cari Stinebower, an international trade lawyer with Crowell & Moring, a Washington, D.C.-based law firm, and a former counsel for the Treasury Department's Office of Foreign Assets Control (OFAC).

The payments gridlock is a testament to the effectiveness of the latest round of financial sanctions, which aim to force Iran to curb its nuclear program and which have made the Iranian banking sector even more radioactive for major global banks.

But they also undercut the long-standing U.S. argument that its sanctions are not meant to squeeze the Iranian people but rather the Islamic republic's leaders and their suspected pursuit of nuclear weapons.

"I am not against punishing Iran for being a rogue country but the United States, or the Europeans, when they start imposing sanctions, then they must consider, also their own companies," Harrington said.

Harrington, an Iranian American who changed his name from Farhad Fouroohi, had to lay off three people in February because of the payments delays, cutting his staff from seven to four.

OUTSIZE IMPACT

While a new U.S. law targeting financial institutions that deal with the central bank of Iran has garnered much attention, sanctions lawyers said the January 23 blacklisting of one Iranian bank had a more immediate, sharp effect on humanitarian trade.

Bank Tejarat, Iran's third-largest bank, was "designated" - or blacklisted - under a U.S. executive order targeting people and companies that promote the proliferation of weapons of mass destruction as well as their support networks.

The action has the effect of cutting them off from the U.S. financial system, along with any bank who deals with them - a risk that many banks find impossible to take.

Over the last five years, the Treasury has blacklisted 23 such Iranian-linked entities, gradually squeezing Iran's ability to do business with the world.

Tejarat's blacklisting has had an outsize impact, sanctions lawyers said, because it had been the last major Iranian bank available for legal trade with Iran. With it now off limits, companies are having to sift through smaller banks to find some that can carry out the transactions - which is no mean feat.

"That has had a huge ripple effect," said Douglas Jacobson, a Washington attorney who focuses on sanctions work.

"On the one hand, you can get a license. The government is saying, 'OK you can sell.' But the practical reality is that you can't get paid," he added.

The lawyer said one of his clients is out several hundred thousand dollars because of the Tejarat blacklisting and that he knows of several medical companies that have stopped exporting to Iran because of the payment problems.

"Where you had a small window of opportunity previously, that window is now almost completely closed," said Erich Ferrari, another lawyer who specializes in trade sanctions. The decision on Thursday by Belgium-based SWIFT, the world's biggest electronic payment system, to expel all Iranian banks blacklisted by the European Union, may make it even harder to?conduct transactions, sanctions lawyers said.

The United States has gradually tightened sanctions because of Iran's failure to answer questions about its nuclear program, which Washington and its allies suspect is a cover to develop nuclear weapons. Iran says it is solely to generate power.

The sanctions became much tougher when U.S. President Barack Obama on December 31 signed a law designed to choke off Iran's oil sales by threatening to cut off foreign banks from the U.S. financial system if they dealt with Iran's central bank.

Merck & Co., the world's third-largest pharmaceuticals company, said it has licenses to sell Iran products to treat diabetes, cancer, respiratory illnesses and infections.

"(Merck) has?experienced a challenging situation in 2012 in terms of securing payments for goods shipped," said Merck spokeswoman Kelley Dougherty, adding that the company was open to ideas that would facilitate humanitarian exports to Iran.

Pfizer Inc, the world's largest pharmaceuticals maker whose flagship products include the cholesterol-lowering drug Lipitor, acknowledged challenges in getting paid for Iranian sales, saying it would work through them. Both Merck and Pfizer declined to provide details.

"There is some turbulence right now," said Pfizer spokesman Peter O'Toole, saying the company wished to ensure that Iranian patients have access to needed medications. "If we have to work through a little turbulence, that's what we'll do."

A Treasury Department official who spoke on condition of anonymity said its approach on humanitarian exports to Iran had not changed, though he did not directly address questions about the difficulty that U.S. companies were having getting paid.

"There's been no decrease in applications to OFAC to export humanitarian items to Iran," the spokesman added. "The recent sanctions imposed on Iran have not changed our approach to the export of food, medicine and medical devices to Iran."

For companies such as Pfizer or Merck, exports to Iran are a tiny fraction of their worldwide business.

If ordinary Iranians ultimately suffer shortages of drugs and medical devices, the Iranian government may use it to score public relations points with their own people against the West, much as former Iraqi dictator Saddam Hussein did in Iraq.

"They need to defend their position to their own population. They need to continue to create this image of an international community that is implacably aligned against the interests of a defenseless Iran," said Suzanne Maloney, a senior fellow at the Brookings Institution's Saban Center for Middle East Policy.

"This kind of imagery would play into that and it'll have a certain resonance among Iranians who have a long experience with sanctions, resent the impact of sanctions on ordinary citizens and believe ... the government is well able to insulate itself."

"WASHINGTON'S EARS ARE CLOGGED"

The United States bars virtually all trade with Iran. It cut diplomatic ties with Iran in 1980 after Iranian students seized its embassy in Tehran and ultimately held 52 Americans hostage for 444 days.

Last year, the United States exported only $229.5 million worth of goods to Iran.

"Woodpulp and pulpwood" - which includes the raw material for diapers - accounted for $57.9 million, followed by $50.1 million for pharmaceuticals, $29.5 million for plastics, $23.4 million for unmanufactured farm products and $22 million for medical devices, according to U.S. Commerce Department data..

Under a quirk in U.S. law, the export of diapers to Iran is not allowed but the export of fluff pulp, their key component, is, creating an opportunity for Harrington to sell it to Iran.

Of the $26.6 million in sales his company had last year, Iran accounted for roughly 70 percent.

The impact has been so big that Harrington wrote U.S. President Barack Obama a plaintive letter on February 9, saying the latest U.S. sanctions "have virtually stopped our business overnight."

"We would appreciate your comments and any suggestions as to what we could possibly do at this point," Harrington wrote. "From our perspective, it would seem that there is nothing left to be done except to close our doors."

Harrington, who argues there should have been a "wind-down" period to clear existing payments, has received no reply.

"We have not received any reaction and I don't expect to," he said. "Washington's ears are clogged. They don't hear it at all."
