Q: We are selling my mom?s place (she moved into assisted living) and a gal she knows wants to be the Realtor. She keeps saying she is representing us, but we have not signed anything with her and don?t really trust her. She wants to show the house to another Realtor and her client. We are not ready, but she has convinced us to let him walk through. Are we obligated to her in any way?

A: You need to contact a lawyer in your area. While you have not signed a contract with her, she will now be procurring cause if the other Realtor and buyer want to buy the home which will cause issues for the Realtor that you do list with (and could result in the local Real Estate Ethics Board taking the commission away from the Realtor that you list with and giving it to the Realtor that you don?t want to use).
You need to NOT show the home to anyone until you have a contract signed with a Realtor that you WANT to use
In the St Louis area, if we show a home that is not on the market (and hence you are a for sale by owner) then we have to have a SIGNED agreement with you PRIOR to showing the home stating that you have agreed to let us show it and stating whether or not you have agreed to pay a commission to us if we bring a buyer to you, but the rules there may be different. Contact the local Real Estate Board and talk to someone on their Ethics Committee.

A: If you do not have a signed listing agreement you are not obligated to her in any way. I would insist on being there for the showing and introducing yourself to the other real estate agent. Make sure that agent knows you do not have representation and if her client wants to purchase the home, that she needs to contact you. Hopefully the gal your mom knows is just trying to help. You can always contact her Broker if you continue to have issues.

A: Since you have already decided to show it to her colleague and the client, I would sit and have a chat with her beforehand and lay out expectations in terms of sales price, commissions, etc. Most agreements have to be in writing, but some oral contracts are enforceable in some states.

A: f you have not signed any sort of agency contract then you are not obligated to do anything with that particular agent. If you do not trust her, I would recommend getting an agent you actually do trust and inform this one of your plans ASAP.
